A return to work letter puts your reinstatement on the record: the leave you took, the exact date you resume, and any medical restrictions your provider imposed. It protects you if your employer later disputes the timing or the terms of your return.

The letter matters most after FMLA or workers' compensation leave, where reinstatement rights depend on documented dates. A dated written notice removes any argument about when you offered to come back.

Why you should announce your return in writing

After protected leave, an employee who offers to return and is refused may have a reinstatement claim, but only if the offer can be proven. A phone call to a supervisor leaves no trace. A dated letter naming your return date, your position, and your medical clearance creates the record that HR departments, and if it ever comes to that, agencies and courts, actually rely on. It also gives your employer the practical details they need: schedule, restrictions, and paperwork.

Send it before your leave ends

Aim to notify your employer at least a week before your return date, or earlier if your company handbook or leave approval letter sets a notice period. Late notice is the most common cause of a bumpy return.

Returning from FMLA leave: what reinstatement means

An eligible employee returning from FMLA leave is generally entitled to the same position or an equivalent one, with equivalent pay, benefits, and conditions. Your employer may require a fitness-for-duty certification before reinstatement if the leave was for your own serious health condition and the requirement was communicated in advance. This letter accounts for that: it states your clearance status and whether the certification is enclosed.

  • Match your return date to the leave dates your employer approved
  • Attach the fitness-for-duty certificate if your employer's policy requires one
  • Quote medical restrictions word for word from your provider's release
  • Keep a copy of the letter and proof of delivery with your leave paperwork

Coming back with work restrictions

If your provider cleared you for light duty or limited hours, say so plainly and quote the restrictions exactly. Under the Americans with Disabilities Act, an employer may have to consider reasonable accommodations for a qualifying condition, and the conversation starts with your written notice. Do not overstate or understate your restrictions: the letter should mirror the medical release so there is one consistent story in your file.

Restrictions are a dialogue, not a demand

Asking to discuss accommodations, as this letter does, invites the interactive process the law expects from both sides. If your employer refuses to engage, the dated letter shows you initiated it properly.

Frequently asked questions

When should I send a return to work letter?

About one to two weeks before your planned return, or within any notice window set by your leave approval or employee handbook. If your recovery timeline changes, send an updated letter rather than calling: the written record is the point.

Do I need a doctor's note to return to work?

Often, yes. Employers may require a fitness-for-duty certification after medical or FMLA leave if the requirement is applied consistently and was communicated when leave was granted. Check your leave paperwork and enclose the certificate if it is required.

What if my employer says my job is no longer available?

After FMLA leave you are generally entitled to the same or an equivalent position. If your employer refuses reinstatement, keep the refusal in writing, keep this letter as proof of your timely offer to return, and consider contacting the Department of Labor's Wage and Hour Division or a licensed employment attorney.

Can I return to work earlier than planned?

Usually yes, but your employer may need a few days to restore you to the schedule, and after FMLA medical leave they can require the fitness-for-duty certificate first. Send the letter with the new date as soon as you know it.

Should I mention my medical condition in the letter?

No. State the leave type, the dates, and the restrictions from your provider's release. Diagnosis details belong in the medical certification, not in a letter that circulates through managers and HR.
